He was sentenced to consecutive sentences of 27-35 years in prison. The officer who fired his weapon during the incident has been identified as Officer Trey Hinton. The Internal Affairs Bureau will conduct a separate but parallel investigation to determine whether CMPD policies and procedures were adhered to during the shooting.

A jury has found 36-year-old Shelton Smith guilty of attempted first-degree murder after he fired at Charlotte-Mecklenburg Police officers in May of 2021. The trial, which was held June 4-11, 2024, took place in courtroom 5370 before The Honorable Robert C. Ervin, Superior Court Judge.

The Mecklenburg County District Attorney’s Violent Crimes Team tried Smith, for the following: attempted first-degree murder, assault on a law enforcement officer with a firearm, and being an armed habitual felon. The jury found him guilty as charged.

During sentencing, the State argued that, because the offense was committed to prevent a lawful arrest, an aggravating factor existed. The jury agreed and found the existence of that aggravating factor. Sentencing the defendant in the presumptive range, Judge Ervin sentenced Smith to consecutive sentences totaling 27 – 35 years in prison.

A suspect is in critical but stable condition after an officer-involved shooting involving the Charlotte-Mecklenburg Police Department Thursday afternoon.

Detectives obtained probably cause to charge the suspect, identified as 33-year-old Shelton Smith, with the armed robbery that occurred at the Royal Inn on May 25, 2021. This resulted in officers attempting to make contact with the suspect before the officer-involved shooting.

Through an investigation, warrants were issued for Smith’s arrest and once released from the hospital, he will be transferred to the custody of the Mecklenburg County Sheriff’s Office and charged with two counts of attempted murder, two counts of assault on law enforcement with a firearm, and possession of a firearm by felon, according to police. Smith will also be charged for an unrelated outstanding warrant for arrest for communicating threats.

Police said warrants for robbery with dangerous weapon, conspiracy to commit robbery with a dangerous weapon and possession of a firearm by felon have been obtained against Smith and will be served once he is released from the hospital.

According to a news release, the member of the Charlotte-Mecklenburg Police Department who fired his weapon has been identified as Officer Trey Hinton. Officer Hinton was hired on September 24, 2018, and is assigned to the North Tryon Division. As is standard procedure with any officer involved shooting, the Internal Affairs Bureau will conduct a separate but parallel investigation to determine whether CMPD policies and procedures were adhered to during the course of the incident. Per department protocol, the officer has been placed on Administrative Assignment.

CHARLOTTE, N.C. — One person was taken to the hospital after an officer-involved shooting in north Charlotte Thursday afternoon, according to the Charlotte-Mecklenburg Police Department.

The shooting happened on Old Interstate Road nearby North Graham Street shortly after 12 p.m. after officers attempted to approach the person who they say matched the description in a recent shooting and armed robbery. The person then took off on foot and a pursuit began.

According to CMPD, the person then shot at officers. After a lethal threat was perceived one of the officers fired a service weapon, striking the individual.

Medic transported the person to the hospital with life-threatening injuries. No officers were injured during the shooting.

Police say a gun was recovered at the scene.

The SBI will be the primary investigative agency for this investigation. Representatives of the Mecklenburg County District Attorney’s Homicide Prosecution Team also responded to assist. As is standard procedure with any officer involved shooting, the Internal Affairs Bureau will conduct a separate but parallel investigation to determine whether CMPD policies and procedures were adhered to during the incident. The officers will be placed on paid administrative leave, which is standard policy whenever an officer discharges a service weapon.

The investigation into this case is active and ongoing.
